Shaun Lew is a Senior Associate in the Litigation Department at Engelin Teh Practice LLC. Previously, Shaun worked as an Associate Director for a boutique intellectual property law firm.

Some of his more prominent matters include:

 

  • Acting for PropertyGuru Pte Ltd (“PropertyGuru”) in the landmark case of PropertyGuru Pte Ltd v 99 Pte Ltd [2018] SGHC 52, dealing with the copying of content by the online property classified website known as 99.co. Shaun served as lead counsel for various later-stage interlocutory applications, and as second-chair for the trial where the client obtained a permanent injunction with damages to be assessed.
  • Strategizing and drafting PropertyGuru’s updated Acceptable Use Policy and Terms and Conditions by applying the principles of contract law to clickwrap and browsewrap agreements.
  • Acting for the copyright right owners of the multi Oscar-winning film Dallas Buyers Club in obtaining pre-action discovery orders in the High Court against three major telecommunications providers to provide the names and addresses of persons who had illegally downloaded the film via the BitTorrent network.
  • Acting for the copyright owners of the cinematographic film Queen of the Desert and Fathers and Daughters in a highly contentious pre-action discovery matter in High Court involving the intervention of the Attorney-General’s Chambers, which involved complex legal issues such as whether downloading slithers of the films amounted to substantial reproduction of copyrighted material and what is the appropriate measure of damages for downloading and uploading copyrighted material on the BitTorrent network.
  • Acting as lead counsel for AC Music Entertainment Pte Ltd, a subsidiary of the Aik Chuan Group in a cross-border entertainment dispute in the High Court against celebrity singer, Melody Tan Yong Xin, and her artiste management company, Melotea Limited. The matter involved a complex security for costs application involving an overlapping claim and counterclaim. The client was awarded final judgment against the Defendants.
  • Acting for Sir Hii Yii Ann in a highly contested matter involving a multimillion dollar mining contract in Abdul Rashid bin Abdul Manaf v Hii Yii Ann [2016] SGHCR 1.
  • Successfully defending an individual at trial as lead counsel against a high networth estates’ claim in conversion of branded handbags and expensive watches.
  • Acting for a local celebrity in highly contested divorce proceedings. After the decree nisi was obtained, Shaun successfully prosecuted the former husband for contempt of court for breach of a custody order under the then freshly minted Administration of Justice (Protection) Act 2016.
  • Acting for an international arms procurer in a claim for service fees against a multinational arms dealer in an arbitration under the SIAC Rules.
  • Acting for a local market leader in the co-living industry, Hmlet, in a cross-border merger and acquisition deal involving the acquisition of Hong Kong co-living company “we r urban”
